Family Law ~ Child RelocationA child relocation is essentially a modification to an existing parenting plan, resulting when the custodial parent intends to relocate outside of the state of Washington or even a substantial distance within the state. The Court considers 11 statutory factors in determining whether a child relocation is appropriate, such as the educational opportunities and resources available in the proposed new location to name two factors. The non-custodial parent, upon notice to him or her that the custodial parent intends to relocate, has the opportunity to object to the relocation, provided the objection is made in a timely manner. The non-custodial parent may not favor the child's relocation since a greater distance between the two may limit opportunities to spend time and visit together. In a child relocation, the non-custodial parent should receive an equal amount of time together with the child or children. The Court will consider whether the advantage in relocating outweighs the possibility of remaining in his/her current location.
