Although the Court prefers placement with a biological parent, the Court will award custody to a third party if a natural parent is unfit or the child's placement with mom or dad is unsafe or hazardous.
Generally, third party actions result when a parent or both parents suffer from a serious addiction, preventing proper parenting of the child. While other factors would also establish a valid basis to petition for third party custody of a non-biological child, such an action is appropriate when no parent biological parent or relative is capable to properly care for a child.
The Court will consider with whom and how best to serve the child's best interests. Yet, bringing such a custody action is not always as easily done as said.
